Terms of Use

These Terms of Use (“Terms”) govern your use of the SmartReply For Google Forms Add-on (the “Add-on”). By installing or using the Add-on, you agree to these Terms and enter into a legally binding contract with SmartReply For Google Forms. If you do not agree to these Terms, do not install or use the Add-on.

1. Agreement to Terms
   By installing, accessing, or using the Add-on, you acknowledge that you have read, understood, and agree to be bound by these Terms, including any additional guidelines, policies, or rules referenced herein (collectively, the “Agreement”).
2. Eligibility
   You must be capable of entering into a legally binding agreement to use the Add-on. If you are using the Add-on on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2.1 General Functionality
SmartReply For Google Forms integrates Google Forms and Gmail to facilitate replying to form responses. The Add-on:

• Listens for form submissions
• Extracts data from responses and transforms it into a human-readable format
• Sends a notification email to the form owner containing the form response from [email protected]
• Provides a "Compose Reply" button accessible via the Add-on’s UI, which when clicked, automatically generates a reply draft in your Gmail account for review, editing, and sending

2.2 No Guaranteed Results
While the Add-on uses AI to generate email content, you acknowledge that the AI-suggested content may not always be accurate, complete, or appropriate. The final responsibility for reviewing and sending any email content lies with you.

3.1 License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Add-on solely for its intended purposes.

3.2 Restrictions
You agree not to:

• Reverse engineer, decompile, or disassemble any part of the Add-on.
• Use the Add-on for any illegal or unauthorized purpose.
• Bypass or attempt to bypass any security mechanism of the Add-on.
• Modify or create derivative works of the Add-on without explicit permission.
• Interfere with the normal functionality of Google Forms, Gmail, or the Add-on.
• Resell, sublicense, or otherwise distribute the Add-on without prior written consent.

3.3 Ownership
All intellectual property rights, title, and interest in and to the Add-on (excluding any user-generated content) remain with us or our licensors.

4.1 Accuracy of Information
You are responsible for ensuring the accuracy and legality of the data you provide to the Add-on (e.g., form questions, form responses, recipient emails).

4.2 Compliance with Laws
You agree to comply with all applicable local, state, national, and international laws and regulations when using the Add-on, including those related to privacy, data protection, and intellectual property.

4.3 Review and Sending Emails
The Add-on sends a notification email to the form owner containing the form response from [email protected]. It is your responsibility to review the form response and use the "Compose Reply" button in the Add-on’s UI to generate reply drafts in Gmail. We do not send emails on your behalf without your explicit action.

5.1 Privacy Policy
Your use of the Add-on is also subject to our Privacy Policy, which explains how we collect, use, and protect your information. By using the Add-on, you agree to the Privacy Policy.

5.2 Data Access
The Add-on requires certain permissions (e.g., Google Forms access, Gmail draft creation) to function properly. Additionally, the Add-on sends notification emails from [email protected] containing form responses. You can revoke these permissions at any time through your Google account permissions page, but doing so may limit the Add-on’s functionality.

5.3 Data Security
We employ reasonable measures to protect your data. However, you acknowledge that no data transmission or storage system can be guaranteed to be 100% secure.

6.1 Integration with Google Services
The Add-on depends on Google Forms and Gmail to function. Your use of these services is governed by Google’s own terms of service and privacy policies. We are not responsible for any acts or omissions by Google.

6.2 AI Providers and Other Services
In certain cases, we may rely on third-party AI services to generate email drafts. While we strive to ensure these providers adhere to appropriate data protection standards, we do not control their activities and are not liable for their actions or omissions.

7.1 “As Is” and “As Available”
The Add-on is provided on an “as is” and “as available” basis. We make no warranties or representations, express or implied, regarding the Add-on’s operation, availability, or accuracy.

7.2 No Warranty of Accuracy or Reliability
We do not warrant that the content generated by the Add-on (or any AI functionalities) will be accurate, complete, or reliable. You are solely responsible for reviewing and final use of any content generated.

7.3 No Warranty Against Interruption or Errors
We do not warrant that the Add-on will function without interruption or error, or that defects will be corrected promptly.

8.1 Indirect Damages
To the fullest extent permitted by law, under no circumstances shall we or our affiliates be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or loss of data, arising from your use of or inability to use the Add-on.

8.2 Aggregate Liability
In no event shall our total liability to you for all claims arising out of or relating to these Terms or your use of the Add-on exceed the amount (if any) you have paid us for the specific Add-on service, or one hundred US dollars (US $100), whichever is greater.

8.3 Jurisdictional Limits
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not fully apply to you.

You agree to defend, indemnify, and hold harmless us, our affiliates, and our respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or in any way connected with:

1. Your violation of these Terms;
2. Your misuse of the Add-on;
3. Your violation of any applicable law or regulation;
4. Your infringement of any right of another person or entity.

1. Termination by You
   You may cease using the Add-on at any time and revoke the Add-on’s permissions via your Google account settings.
2. Termination by Us
   We reserve the right to suspend or terminate your access to the Add-on at any time, with or without notice, if we believe you have violated these Terms or if we decide to discontinue the Add-on.
3. Effect of Termination
   Upon termination, all licenses and rights granted to you in these Terms shall immediately cease. Sections intended to survive termination, such as Disclaimers of Warranty, Limitation of Liability, and Indemnification, shall remain in effect.

We may update these Terms at any time to reflect changes in our practices, services, or legal requirements. The most current version of the Terms will be posted here and will supersede any previous versions. By continuing to use the Add-on after modifications become effective, you agree to be bound by the updated Terms.

These Terms and any dispute arising out of or relating to them or the Add-on will be governed by and construed in accordance with the laws of [Your Jurisdiction]. You agree that any dispute arising under these Terms shall be resolved exclusively in the courts located in [Your Jurisdiction], and you consent to the personal jurisdiction of such courts.

13.1 Entire Agreement
These Terms, along with the Privacy Policy and any additional agreements or policies referenced herein, constitute the entire agreement between you and us regarding the Add-on.

13.2 Severability
If any provision of these Terms is held to be invalid or unenforceable, such provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

13.3 No Waiver
Our failure to enforce any right or provision in these Terms shall not constitute a waiver of such right or provision.

13.4 Assignment
You may not assign or transfer these Terms or any rights or obligations herein without our prior written consent. We may assign or transfer these Terms without restriction.
